EClaims, Inc.("LICENSER") IS WILLING TO LICENSE THE EClaims.com INTERNET MEDICAL ELECTRONIC BILLING SITE TO YOU ONLY IF YOU ACCEPT ALL OF THE TERMS IN THIS LICENSE AGREEMENT. PLEASE READ THE TERMS CAREFULLY BEFORE YOU BEGIN MEMBERSHIP REGISTRATION, BECAUSE BY REGISTERING AS A MEMBER YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, LICENSER WILL NOT LICENSE THE USE OF THIS SITE TO YOU.

Ownership of the Internet Site

The site is owned by Licenser and the site is fully copyrighted and is protected by United States Copyright laws, by laws of other nations, and by international treaties. No logo, graphic, sound or image at this website may be copied or imitated in whole or in part. No ownership rights are granted to you, only a license to use the site by you and/or your designated employees.

Grant Of License

Licenser grants to you the right to use one member data base and access this data base via the internet. You may load one copy of your data base into permanent memory of one computer and may use that copy, as a backup of your data base. This license is valid only for use within the United States of America and its territories.

Restrictions on Use and Transfer

You may not use, loan, rent, transfer, or assign your site license and membership to another user for any reason or purpose what so ever.

Limited Warranty

Licenser warrants that EClaims.com Medical Billing and Patient Accounting site will perform substantially in accordance with the site documentation for a period of 30 days. Any implied warranties are limited to 30 days. The suitability of the site to your particular application needs is not expressed or implied and is suitability to your particular application needs is not guaranteed. Some states do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.

LICENSER DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO INTERNET SITE. This limited warranty gives you specific legal rights. You may have others, which vary from state to state.

LICENSER'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE A RETURN OF THE MEMBERSHIP FEES PAID. This remedy is not available outside the United States of America.

This Limited Warranty is void if failure has resulted from modification, accident, abuse, or misapplication.

IN NO EVENT WILL LICENSER BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM ANY LOSS OF PROFITS, LOST SAVINGS, LOSS OF DATA OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THIS INTERNET SITE. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

This Agreement is governed by the laws of the State of Nebraska.
